Strategic Procurement

We provide strategic procurement services across all sectors, including housing, education, healthcare and leisure, ranging from simple to complex procurements. The Team have been involved in procuring some prestigious contracts including UCLH Proton Beam Therapy Centre, Moorfields Eye Hospital and PlayZones mini-pitches for Football Foundation. We adopt a flexible, commercial approach to procurement, focusing on innovative outcomes to deliver client requirements within the regulatory framework. We work with a number of legal firms who provide support on more complex procurements.

We are competent in administering procurements under the old procurement rules (Public Contracts Regulations 2015) where frameworks are still in place and clients are running “call-off competitions”. We are also competent in the delivery of any new procurement under the new procurement rules (Procurement Act 2023).

We also advise organisations who feel that might have been treated unfairly during a procurement and work with them and our recommended panel of litigation lawyers to challenge unfair and poor procurement practice.

We provide a range of dispute avoidance and resolution services.

For Dispute Avoidance, we act in the role of Partnering Adviser & Independent Adviser on the collaborative contracts, PPC2000, TAC-1 and FAC-1, supporting Project Teams deliver their contracts in the most efficient way and free of disputes.

For Dispute Resolution, we use mediation, expert determination, Med-Adj and Adjudication to help resolve disputes. Our preference is always to use mediation first to allow those in the dispute to work through their issues, through a facilitated process, rather than taking the decision making away from the parties.

In addition, we act as Expert Witness and Expert Determinator on a range of disputes, including disputes relating to building contract disputes, building pathology and quantum disputes, all within our respective fields of expertise.

Dispute Avoidance & Resolution

Business Advisory Services

We provide business advisory services to clients in the construction industry. Typically, acting in a Non-Executive Director (NED) role but in a consultative capacity. This involves being instructed by clients to undertake research work to report back to the C-Suite and to help implement change and initiatives in the business. The specialisms are around supply chain management and procurement, marketing and business development and growth, through acquisition, merger, strategic alliance or organically. In addition, we work with SMEs in supporting the implementation of quality and environmental standards (ISO9001 and ISO14001) and developing business management systems to ensure their businesses are lean and efficient.

Training

We provide a range of training services, particularly geared around those in the sector, using the alliance contracts PPC2000, TAC-1 and FAC-1. Neil Thody is an approved trainer for the Alliance Steering Group. In addition, we offer tailored training programmes for you and your teams. Where appropriate, we will bring in specialists across a spectrum of required learning outcomes, including behavioural, relationship building, conflict avoidance, collaborating in teams and organisational change. We also offer 1-2-1 coaching and thought leadership programmes.
